        <title> Decision of the Supreme Court of the US in illegal copying of patented Soyabeans of patent holder Monsanto, last Monday 13-5-2013 </title>
        <description> The U.S. Supreme Court ruled unanimously Monday that when farmers use patented seed for more than one planting in violation of their licensing agreements, they are liable for damages. Billed as David vs. Goliath, the case pitted an Indiana farmer against the agribusiness behemoth Monsanto. Almost all the soybean farmers in the U.S. use seed that is genetically altered to be resistant to weed killers like Roundup. That allows farmers to spray for weeds without killing the soybeans. But the seed is three times more expensive than regular unpatented seed, so some farmers have tried to use regenerated seed to save money. Case in point, 75-year-old farmer Hugh Bowman, who regularly bought Monsanto&#39;s Roundup-resistant soybean seed for his first growth and signed a licensing agreement promising to use all the seed and not to use any regenerated seed for future use. But Bowman also had other riskier, lower-yield plantings, and for those, he wanted "a cheap source of seed." So he went to the local grain elevator where farmers drop off their harvested soybeans, and he bought and planted some of those, knowing that those beans would likely also be Roundup-resistant. He eventually produced eight separate crop yields using the second and third generations of the grain elevator seed, and he was quite open about what he was doing. "I couldn&#39;t imagine that they&#39;d give a rat&#39;s behind," he said. But they &#226;&#128;&#148; namely, Monsanto &#226;&#128;&#148; did. The company sued Bowman, as it has sued other farmers. Bowman lost in the lower courts and was ordered to pay $84,000 in damages to Monsanto. He appealed all the way to the U.S. Supreme Court. There the question before the justices pitted two legal doctrines against each other. One doctrine, known technically as patent exhaustion, says that once you buy a product &#226;&#128;&#148; say, a cellphone &#226;&#128;&#148; you can do with it whatever you want. You can use it, sell it, give it to your kids, whatever. But a second patent doctrine says you are forbidden to copy it. So which rule applied in Bowman&#39;s case? The Supreme Court said unanimously that Bowman&#39;s actions amounted to illegal copying of a patented product, a sort of farming piracy. Writing for the high court, Justice Elena Kagan said that Bowman is perfectly free to purchase grain elevator beans to eat or feed to livestock, or even to resell, but he could not do what he, in fact, did: plant the beans from the grain elevator in his own fields, test them for weed resistance, and then harvest, re-harvest and re-harvest multiple times, without paying Monsanto for use of its patented product. Without this protection for Monsanto, said Kagan, the company would get "scant benefit" from its invention, and Bowman and other farmers would reap great rewards from the weed-resistant seed without paying for it. Kagan also rejected Bowman&#39;s argument that since soybeans naturally self-replicate by sprouting, it was the soybean, not Bowman himself, that made replications of the Monsanto&#39;s patented invention. "We think the blame-the-bean defense tough to credit," said Kagan. Bowman, she noted, "was not a passive observer of his soybeans multiplication." Instead, Bowman himself produced eight separate crop yields using the grain elevator beans to maximize regeneration of the beans. Monsanto and other agribusiness enterprises were predictably pleased by the decision. "The court&#39;s ruling today ensures that long-standing principles of patent law apply to breakthrough 21st century technologies," said David Snively, Monsanto&#39;s executive vice president and general counsel. "The ruling also provides assurance to all inventors throughout the public and private sectors that they can and should continue to invest in innovation that feeds people, improves lives, creates jobs and allows America to keep its competitive edge." Meanwhile, critics of the industry were just as predictably disappointed. Andrew Kimbrell, director of the Center for Food Safety, called the decision a "disaster" for farmers and consumers, because it ensures that Monsanto&#39;s soybean seed patent will dominate the market even more, meaning that prices for both farmers and consumers will soar. The court&#39;s decision, however, was explicitly limited to cases like Bowman&#39;s, where an individual takes steps to replicate a patented product. Justice Kagan said the court was not deciding how to handle all self-replicating products &#226;&#128;&#148; products that range from patented DNA molecules to computer software. Or as John Whelan, George Washington University associate dean of intellectual property law put it, the court has "left for another day" the question of how to treat a product that "automatically reproduces itself with no intervention." In the modern world of complex new inventions, it seems the court is not eager to get ahead of itself. </description>

The database is a new tool to facilitate information of breeders on the patent status of plant material: the association is setting up a new database that shall provide an overview on the patent status of commercially available plant varieties.In its position on IP protection for plant-related inventions ESA identified the need for more transparency regarding the patent status of plant varieties and committed itself to increase such transparency. &#160;Despite the fact that there are already a number of publicly available databases in relation to patents, information providing the link between individual varieties and individual patents currently is not available anywhere. But when starting a breeding program, it is of critical importance to breeders to know whether the biological material they intend to use may fall under the scope of an already granted patent or even a patent application. Where such information is lacking, breeders may be discouraged to make use of important genetic resources which, in the end, may even slow down innovation in breeding. ESA&#226;&#128;&#153;s database project is meant to fill this information gap and thus allow breeders to&#160; make a more informed choice. </description>

        <description> Medicinal and aromatic plants in many forms have been used since the ancient times in the traditional medicinal practices for health care. South Asia is home to many rich, traditional systems of medicine (TSM). Ayurvedic system dates back to 5000 B.C. Along with the Unani, Siddha and Tibetan systems, these TSMs remain important source of everyday health and livelihood for tens of millions of people. According to WHO report, Medicinal plants are accessible, affordable and culturally appropriate sources of primary health care for more than 80%&#160; of the world population relies on traditional medicine largely plant based for their primary healthcare needs. According to WHO, the international market of herbal products is estimated to be US $ 62 billion which is poised to grow to US $ 5 trillion by the year 2050? With increasing popular demand for medicinal plants, both in Asia and internationally, this trade is expected to grow to 5 trillion by the year 2050. Aromatic plants and their products particularly essential oils are becoming more important. Traditional medicine is, at the present time accepted as an alternative for or used in conjunction with the western medical practice in many countries.         <title> Tim Briercliffe appointed as Secretary General AIPH </title>
        <description> AIPH to expand activity for growers with appointment of new Secretary GeneralThe Executive Committee of the International Association of Horticultural Producers (AIPH) has confirmed the appointment of Tim Briercliffe as the new Secretary General of the association.&#160; This full-time role results from an internal review of AIPH activity and was created to drive the growth of AIPH.&#160; The position will spearhead a new phase of activity focusing on meeting the needs of growers across the world.Tim Briercliffe, based in Reading near London in the United Kingdom, will be responsible for working closely with the association&#226;&#128;&#153;s members throughout the world to tackle common challenges facing the sector. Supporting the existing committees covering Marketing, Statistics, Novelty Protection, Green City, Environment and Plant Health, and Science and Education he will look to strengthen the impact of the association as the voice of the ornamental horticulture industry worldwide.Tim Briercliffe joins AIPH with extensive experience within the industry having led sector committees, policy, science, certification schemes, market information, training and careers, events, communications and business improvement activities and initiatives, as Director of Business Development at the Horticultural Trades Association (HTA) in the UK for the last eight years.&#160; Prior to this he worked as a Senior Horticultural Consultant within ADAS, a major UK consultancy company.&#160; He has a horticulture degree from Reading University and has worked on nurseries in the UK and Canada.Commenting on the appointment AIPH President Vic Krahn said &#226;&#128;&#156;I am delighted to welcome Tim into AIPH and look forward to working closely with him.&#160; Tim has just the range of experience and expertise that we need to work with the members in developing and implementing a strategy for the future.&#160; There are many challenges facing ornamental horticulture that cross country boundaries and we are best tackling them together.&#160; I am delighted that AIPH is now resourced to tackle these challenges head-on.&#160; The work of approving and promoting horticultural exhibitions worldwide remains a key part of what AIPH does as we promote the sector to the world&#226;&#128;&#153;s consumers.&#226;&#128;&#157;Briercliffe will operate from the HTA offices in the UK and Vic Krahn continued &#226;&#128;&#156;I am particularly pleased that Tim will be based at the HTA offices and grateful for the support they are providing&#226;&#128;&#157;.Commenting on his appointment, Briercliffe said &#226;&#128;&#156;I am looking forward to the opportunity to continue and develop the important work of AIPH.         <title> CIOPORA Annual General Meeting (AGM) April 22-25, 2013 in Angers; CIOPORA prepares a new Green Paper and CIOPORA launches a new website. </title>
        <description> CIOPORA will dedicate the full day of her AGM 2013 to internal debate on a new CIOPORA position on Patens and modern PBR in horticulture. CIOPORA is of the opinion that such new position seems necessary because of the far reaching new developments in horticultural breeding in the past decade and the still existing weakness in the IP protection systems for plant innovations. The new CIOPORA position is also intended to update the CIOPORA Green Paper, which is ten years old now. Hereto an discussion paper will be presented to the AGM 2013. The results of this discussion will be incorporated in a new draft to be further discussed in the course of 2013. The final decision on the new CIOPORA position will be made at the 2014 AGM, which will take place in the Netherlands. Ten years ago AIPH has written and published a comment on CIOPORA&#226;&#128;&#153;s Green Paper 2002 and will receive this new Green Paper with large interest of course. Finally CIOPORA has launched an updated website featuring new content and an all new look (see www.ciopora.org). </description>

        <title> English version report roundtable discussion in the Netherlands available </title>
        <description> Last month the English version of the report of the oral consultation hold in summer 2012 in the Netherlands has been published. The Dutch version was published in August 2012. &#160;The oral consultation was organized by the Dutch Government of all the concerned parties (think of VBN, LTO, Plantum, Niaba (umbrella organization of biotech firms) and Nefarma (umbrella organization of pharmaceutical firms)) and big firms (think of Monsanto, Tata Steel Europe, Unilever, Akzo Nobel, Syngenta) to figure out and to discuss with all the parties about the feasibility and desirableness of the full breeders exemption in patent law and to discuss the effects (the pros and cons) of the full breeder&#226;&#128;&#153;s exemption. Also the so called &#226;&#128;&#152;industry led solution&#226;&#128;&#153; (see annex 7 to the NP agenda of the spring meeting 2012 for explanation) is part of the report of this consultation. The accompanying letter from Mr. Trojan, the discussion leader and writer of the report, contains a summary of the essentials. The introduction letter of the Dutch minister of Economic Affairs is attached as well. Mia Buma, secretary of the AIPH Committee for Novelty Protection, will inform the members further about the reactions on and the follow-up of this report in spring meeting 2013.         <title> 2013 Edition of the Communities in Bloom International Challenge </title>
        <description> Communities in Bloom will organize the 2013 Edition fo the Communities in Bloom International Challenge. The International Challenge involves winners from different National Programs (Communities in Bloom, Britain in Bloom, America in Bloom, Tidy Towns of Ireland, Japan in Bloom, Entente Florale and others) competing with each other based on population categories. Invitations are also sent to communities from countries without National Programs. The International Challenge consists of communities receiving information and being evaluated by an international jury on the accomplishements of their entire community (municipal, private, corporate and institutional sectors, citizens) on eight key criteria: tidiness, environmental awareness, community involvement, natural and cultural heritage conservation, urban foresty, landscaped areas, floral displays, and turf &amp; groundcovers. The evaluation takes place in July and August. The 2013 National Symposium and Awards Ceremonies will be held in Ottawa, Ontario, Canada&#226;&#128;&#153;s Capital Region from October 23rd &#226;&#128;&#147; 26th, 2013.
